Przedmiot badań. Niniejsza publikacja stanowi próbę analizy podstaw prawnych dopuszczenia do obrotu surowca farmaceutycznego przeznaczonego do sporządzania leków recepturowych i aptecznych, w ujęciu zasady legalizmu.

Materiały i metody. W artykule zastosowano metodę formalno-dogmatyczną obejmującą analizę obowiązujących aktów normatywnych z uwzględnieniem: (i) orzecznictwa oraz (ii) doktryny prawa.

Wyniki i wnioski.

Słowa kluczowe: surowiec farmaceutyczny, dopuszczenie do obrotu, decyzja administracyjna, podstawa prawna, zasada legalizmu, właściwość rzeczowa, kompetencja.

Legal basis for granting marketing authorization to pharmaceutical substances intended for the preparation of extemporaneous and officinal medicinal products: the principle of legality

Research’s subject. This article examines the legal basis for granting a marketing authorization for pharmaceutical raw materials intended for the preparation of magistral and officinal medicinal products in light of the constitutional principle of legality. The placing of such pharmaceutical raw materials on the market is subject to statutory regulatory control, which requires the competent public administrative authority to act exclusively on the basis of an explicit legal provision conferring the relevant jurisdiction and competence. The principle of legality imposes an absolute obligation upon public administrative authorities to act solely on the basis of, and within the limits prescribed by, the law, that is, within the scope of the jurisdiction and competence conferred by substantive legal provisions. Consequently, the competence of a public administrative authority may neither be presumed nor derived through purposive or systemic interpretation of legal norms. An analysis of the provisions of the Polish Pharmaceutical Law Act demonstrates that the existing regulatory framework requires legislative clarification in order to establish an explicit and legally adequate basis for the exercise of the powers of the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products (hereinafter: the President of the URPL) with respect to the granting of marketing authorizations for pharmaceutical raw materials. The significance of this issue stems from the legal consequences of administrative action undertaken without a proper legal basis, which may result in a declaration of invalidity of the administrative decision concerned, including a final administrative decision.

Purpose. The objective of this study is to examine the legal basis for granting marketing authorizations for pharmaceutical raw materials intended for the preparation of magistral and officinal medicinal products from the perspective of (i) the constitutional principle of legality, (ii) the general principles governing administrative proceedings, and (iii) the provisions of the Polish Pharmaceutical Law Act.

Materials and Methods. The study employs the formal-dogmatic method, involving an analysis of the applicable normative acts, supplemented by an examination of relevant judicial decisions and legal doctrine.

Results and Conclusions. The principle of legality constitutes one of the fundamental principles underpinning public law and, in particular, determines the legal framework governing the activities of public administrative authorities. An assessment of the legal provisions defining the jurisdiction and competence of the
President of the URPL with regard to granting marketing authorizations for pharmaceutical raw materials intended for the preparation of magistral and officinal medicinal products provides sufficient grounds for the formulation of specific de lege ferenda proposals. In particular, the analysis supports the amendment of the Polish Pharmaceutical Law Act in order to establish an explicit legal basis defining both the jurisdiction and the competence of the President of the URPL to issue administrative decisions granting marketing authorizations for pharmaceutical raw materials intended for the preparation of magistral and officinal medicinal
products.
